Caution Regarding Virtual Asset Service Providers Claiming To Be Affiliated With Seychelles

The Financial Services Authority (FSA) have issued a press release cautioning the public against Virtual Asset Service Providers (VASPs) claiming to be licensed by the Seychelles. The FSA hereby informs the public that the companies listed in Annex 1 to this Press Release are only registered or incorporated in Seychelles.  

 

 

Alert: Huobi Global Limited (194154)

This notice is issued by the Financial Services Authority ("FSA") pursuant to section 4(1)(m) of the Financial Services Authority Act, 2003 in relation to the International Business Company ("IBC"), Huobi Global Limited with company number 194154 incorporated pursuant to the International Business Companies Act, 2016 (“IBC Act”).
 
Through information available in the public domain, Huobi Global Limited appears to be affiliated with an online trading platform for virtual assets, namely “Huobi Global”, and is soliciting investors and customers through its website: https://www.huobi.com/.
 
The FSA hereby informs the public that Huobi Global Limited does not hold, nor has it ever been issued with, any license or authorization by the Seychelles FSA, to undertake any virtual asset (VA) or virtual asset service providers (VASP) related activities. Therefore, the entity is currently not being regulated for these activities by the FSA nor has it been regulated in the past.
 
The public is further informed as to the fact that Huobi Global Limited was struck off the Register of International Business Companies, on the 13th October, 2023, in accordance with section 272(b)(ii) of the IBC Act for failing to have a registered agent.
 
In light section 274(1) of the IBC Act, Huobi Global Limited is not allowed to, amongst other things, carry on any business, deal with the assets of the company in any way or act in any way with respect to the affairs of the company.
 
The effect of the striking off does not prevent:
 
a) Huobi Global Limited from incurring liabilities;
b) any creditor from making a claim against Huobi Global Limited and pursuing the claim through to judgment or execution; or
c) the Financial Intelligence Unit, Seychelles Revenue Commission or any other governmental body from making a claim against Huobi Global Limited under a written law of Seychelles and pursuing a claim through to judgement or execution,
 
and does not affect the liability of any of its member, directors, other officers or agents.
 
The FSA strongly urges investors and members of the public to exercise caution in respect to the VA and VASP services offered by Huobi Global Limited where they are held out as being regulated in the Seychelles.

Surrender of Clifton SC Limited and Clifton Trust Limited's International Corporate Services Licence and Trustee Licence

The Financial Services Authority, hereby informs the public, that Clifton SC Limited and Clifton Trust Limited, having its registered address at Suite 202, Sham Peng Tong Plaza, Victoria, Mahe, SEYCHELLES has surrendered its International Corporate Services Licence and Trustee Licence pursuant to Section 30(1) of the Financial Services Authority Act, 2013 ("FSA Act") effective November 20th, 2023.

Pursuant to section 4(1)(m) of the FSA Act, the public is hereby notified that the company Clifton SC Limited no longer holds an International Corporate Services Licence No. ICS 002 and Trustee Licence No. 001.

All parties concerned kindly contact the FSA, until informed otherwise, in respect to records of specified entities that were under the administration of Clifton SC Limited and Clifton Trust Limited at the time of the surrender.

The FSA and ROC hereby informs the public that the businesses listed in Annex 1 to this Press Release are not registered or incorporated in Seychelles.

Unlicensed Interactive Gambling Activity

This notice is hereby issued by the Financial Services Authority of Seychelles (“FSA/Authority”) in accordance with its powers to issue public statements, as awarded by section 28 of the Financial Services Authority Act, 2013.

The Authority’s attention has been drawn to the activities of a company operating within the Seychelles under the name “1xbet” with the following website https://1xbet.com/en.
 
The FSA would hereby like to inform members of the general public and all relevant persons as to the fact that 1xbet is not licensed by the FSA to conduct interactive gambling services (online live betting, casino and slot games) in and/or from within the Seychelles nor does it hold any other licence as may be issued pursuant to the Seychelles Gambling Act 2014 ("Gambling Act”).
 
The FSA Seychelles urges members of the public to exercise caution if soliciting or partaking in any services or products being offered by 1xbet and to be advised that they will be doing so at their own risk.
 
This notice in no way implies that 1xbet is not licenced in another jurisdiction but impresses on the fact that they presently do not hold a licence under the Gambling Act.
 
The FSA reminds the public that should they continue to utilize or engage in services or products provided by the aforementioned company, as they are not licensed by the FSA, they are not protected under the Seychelles Gambling Act and other relevant laws, which govern such entities licensed in the Seychelles.
